We Got a Diagnosis For Our Child ? Now What? ADHD, ODD, LDs ...

A diagnosis is an important piece of the puzzle we are trying to solve when we try to help kids with disabilities learn how to function. Many parents are relieved when they get a diagnosis for their acting-out, ?problem child? because they see it as a guideline for the future. They think, ?Now we?ll know what to do; this is it- we?ll finally get our child the help he needs.? The truth is that I?ve seen families go through the drudgery of doctors and diagnoses many times. I?ve worked with kids who had Attention Deficit Hyperactive Disorder (ADHD), Oppositional Defiant Disorder (ODD), Conduct Disorder, Obsessive Compulsive Disorder (OCD), and many others. I?ve also seen individual kids with five different diagnoses: every time they were hospitalized or went to a new therapist, they would get a new one. But sadly, in the end their parents were left with the fact that simply having a diagnosis didn?t necessarily mean they could get help improving their child?s behavior, or get them the skills they needed to learn how to function successfully.

A diagnosis doesn?t mean that you are assured treatment for your child from which you will see change.

A diagnosis doesn?t mean you?re going to get funding to help give your child the success he needs. And a diagnosis does not mean he?s going to get the services he really needs. Sadly, there are no guarantees. I?ve worked with many parents whose kids had been given multiple diagnoses, but their children were still punching holes in the wall, cursing them out and having meltdowns at home and in school.

So, What Does a Diagnosis Do For Your Child?

Special Education Funding: In the states where I?ve practiced, when your child gets a certain diagnosis, you can often access special education funding. The sad fact is that children with labels attract money; children without labels don?t attract any money. That should not be discounted, because money-the means to get the services that will help your child learn how to manage his life-is a big issue. Many schools and mental health agencies have huge financial difficulties, and children with special needs are competing to get the services they need.

Special education funding often depends on what the diagnosis is. If someone has a diagnosis of ADHD, for instance, they will attract special education funding if it interferes with the child?s education. But if somebody has a diagnosis of Conduct Disorder or Oppositional Defiant Disorder, they usually won?t get any special education funding or services. This is because Conduct Disorder and ODD are behavioral issues, which can be determined not to specifically interfere with learning.

Medication for Your Child: Getting a diagnosis also can lead to a prescription for your child. With ADHD, in many cases medication can be very helpful. For OCD, medication is almost always indicated unless there are other medical concerns. But there is no medication that deals specifically with behavioral issues like ODD or Conduct Disorder, because again, these are cognitive in nature. Doctors may try different medications, including some anti-psychotics, but most often these behavioral disorders don?t respond to medication.

?Someone Finally Understands My Child?s Problem!? Many parents feel lost with their acting-out or learning disabled kids, as if nobody understands their child-or has a solution for them. Many times when you get a diagnosis, you feel as if somebody finally understands what?s going on, and that may very well be the case.Unfortunately, just because someone understands what?s going on, it doesn?t make your child more treatable. While the vehicle of treatment may change from diagnosis to diagnosis, the goal remains the same: to help that child acquire the skills he will need to function as an independent adult. He still needs to be held accountable for his actions.

Getting the diagnosis can affect funding and perhaps get your child a prescription, but it does little else. And parents who feel hopeful when they get that diagnosis have only won half the battle. The sad reality is that our current public and private mental health system do not yet possess the knowledge and theory base to effectively treat their child. I?m sure there has been success out there for many individual cases, but the families I?ve dealt with have experienced a lot of disappointment at the outcome of the treatment milieus they?ve been involved with.

1. A Diagnosis Does Not Relieve Your Child of Responsibility.

In my opinion, there is nothing wrong with saying, ?My child behaves this way because he has ADHD.? Just know that does not relieve either the parent or the child of the responsibility of learning how to function appropriately. In other words, if you use the diagnosis as an excuse for not challenging your child?s behavior and not doing things that will promote change, I think you?re making a big mistake. Let?s face it, kids with OCD, ADHD, Conduct Disorder, and ODD are all going to become adults some day, and they?re going to need the skills to make it in the real world. Depending upon the diagnosis, when they turn 18 or 20 any funding that might be available stops. Unless your child has a severe Pervasive Developmental Disorder, a developmental disability, Schizophrenia or some other critical disability, there is no more money for him after he ages out of your health insurance or leaves school.

That is why it is imperative that your child gets the skills he needs to function in the real world as early as possible. Otherwise, success will be very difficult for him to attain in his life. Playing ?Catch-up? is a really tough task for kids with behavioral disorders, and a significant number of them are never able to do it.

Let me put it this way: if you don?t know how to manage your feelings, manage your behavior, be productive, and respond to people in an appropriate way ? if you don?t learn how to do that by age 18, that diagnosis doesn?t count anymore. Nobody cares. Believe me, the guy you?re working for at 7-11 doesn?t care if you have ADHD or not. He wants you to stock the shelves. And he wants you to do it with a nice attitude and a smile. If you?re not willing to do that, he will get somebody else who will. And I believe in the job market that?s coming, you?re going to have to be really skillful to maintain any kind of decent career. Kids who have disdain for fast food jobs are going to wind up seeking that kind of work just to survive.

It should also be understood that while the juvenile justice system tries to be flexible and understanding about learning disabilities or other disorders, after the age of 18, kids enter the adult correctional system. If you tell a judge the reason you broke into a car is because you have ADHD, he?s going to give you a dressing down you?ll never forget. While kids get a lot of flexibility, the fact is, adults aren?t able to hurt others, exploit others or do mean things and get away with it just because they had a learning disability or conduct disorder as a child. That is probably the rudest awakening I see teens with behavioral disorders go through. One month they?re in juvenile court running everyone around and playing games, and the next month they?re in county jail and nobody but their parents cares about them.

2. Don?t Use a Diagnosis to Make Excuses for Your Child.

Don?t use a diagnosis to make excuse for your child; use a diagnosis to understand him. When you do this, you?ll be able to figure out a way to teach him how to function and how to perform effectively. Certainly, the way you deliver information to somebody with ADHD might be different from the way you deliver it to somebody who has ODD. While your tone may vary, know that both of these kids need the same information, because at 18 or at 20, they are going to have to meet the same expectations.

Let?s be very clear, there?s going to be no free lunch in our society anymore. So kids who aren?t making it are going to be homeless or they?re going to be living in your home. And not only that, their behavior won?t have changed. They?re still going to be demanding, lazy, self-centered and domineering. You?ll constantly hear them making excuses, blaming others and playing the victim. What they won?t do is change on their own.

3. With or Without a Diagnosis, Your Child Needs Skills.

It is very important that parents understand that no matter what the diagnosis is, these kids have to have a bundle of skills if they?re going to make it in the adult world. A diagnosis can help indicate how we deliver those skills to them. So for the girl who has ADHD, the boy who has Conduct Disorder, the teen who has OCD, they all are still going to have to work and support themselves. That?s simply the reality of the situation: that is the way of the world.

If you make excuses for your child by saying ?That?s the diagnosis talking? and if you don?t take any action to get him the skills he needs-and demand that he learns them-you?re giving up. And by the way, giving up is very easy to do. I?m not judging parents, by any means. These kids are overwhelming, and families do give up because they get exhausted. But understand this: these kids still need to get those skills. If they don?t, there?s a good chance they?re going to end up living with you into adulthood, be out on the streets, or in a correctional institution.

4. Kids with Learning or Behavioral DisabilitiesNeed Training the Most, but They?re the Ones Who Get it the Least.

Let?s look at the diagnosis from the child?s perspective. My son was diagnosed with Attention Deficit Disorder as a kid. We worked with the school, but he still always felt ?less than? the other children. Understand that at the core of these kids with behavior problems or learning disabilities, they?re angry. They?re ashamed of themselves and they feel like they?re damaged goods. And that just makes them feel more hopeless, which triggers more acting-out. Their perspective on their diagnosis is, ?There?s something wrong with me.? That?s why they?re always making excuses, blaming others, and saying, ?It?s not me, it?s them.? In this way, they defend themselves from the feelings of shame and anger. They see that the other kids can meet their responsibilities and they know they can?t-or won?t. They see the other kids getting along socially, and they know they don?t get along with anybody. They have a big denial mechanism that neutralizes those thoughts, and many of them end up walking around in their own little self-centered world, acting out and becoming more and more destructive.

In my opinion, if any child needs to learn how to manage their behavior effectively, it is a kid with learning or behavioral disabilities. In fact, they need it more than the other kids who are successfully learning how to do it as they develop. When a child has a learning or behavioral disability, he needs to work harder to be prepared for adulthood. Unfortunately, these kids are the ones that need training the most, but they?re the ones who get it the least.

I used to work with kids in a youth correctional center. Many of them had a lot of learning disabilities. Very few of those youth were what would be considered ?normal? school kids. They all had a diagnosis of something like ADD, ADHD, Oppositional Defiant Disorder, or Conduct Disorder, which becomes criminalized when you get into your late teens or even mid-teens. These are the kids ? the kids with untreated ADHD, untreated ODD, and Conduct Disorder-who start doing criminal things in adolescence. And if they don?t learn how to manage themselves effectively somewhere along the way, they get lost in the correctional system. Or they become lost in lives of substance abuse because it gives them a release from the pain of not being able to function. So you often see a high percentage of drug addiction and alcoholism amongst these children. And you see a high percentage of people in prison who have learning disabilities. Many, many inmates can?t write and read, and thousands and thousands of people get their GEDs in prison while they?re doing time.

5. To Medicate or Not to Medicate?

My view on medication is that it?s up to the parent to decide what?s best for the child. I urge parents to go into it with an open mind, to weigh out the benefits and the risks. Try to determine ahead of time how you will know if the medication is working or not working, within a proscribed period of time. So it?s not only ?Put my daughter or son on medication,? it?s ?If we put them on it and it works, what will we see in 4 weeks?? Conversely, ask yourself, ?How will we know it?s not working and what will we do?? Parents should be informed consumers of the information regarding what medication their kids are using, and what the therapist hopes to accomplish.

Medication can be over-prescribed. I?ve seen kids on three or four very powerful prescriptions, and unless you have a good doctor who is monitoring everything very closely, know that many of these drugs can be harmful to the liver and kidneys. It?s important that you keep your child?s pediatrician informed of the meds he?s on. That being said, I think medication should be tried if you and your pediatrician determine that it might be helpful, and after a thorough screening and examination. Also, I think that medication should only be prescribed by a child and/or adolescent psychiatrist. Only they have the firsthand knowledge of how these very complex chemicals interact with other chemicals in the brain. I don?t think pediatricians or nurse practitioners or any other professionals who have the right to prescribe should be dispensing psychotropic medication for children.

Personally, I think it?s often worth it to take a chance with medication, if the drugs can support your child?s ability to self-manage sufficiently so he can learn the skills he?ll need. Don?t forget, all these methods we?ve been talking about are different vehicles that work to get information to our kids on how to behave and learn to grow up. They are all, in effect, ?service delivery vehicles?. The service is that we?re getting our kids to behave and get some necessary life skills. Medication, special education, therapy, books and other resources are all examples, different ways to deliver the service of independent functioning to our children. Make no bones about it, as a parent, you need to be proactive and search out the best method for your child, in order to help him function in the grown up world.

I believe these kids can change, and that the process of change works best when it starts at home. I?ve worked with acting-out children for thirty years, and I?ve found that if there?s a culture of accountability at home or in school, it enhances these kids? potential to respond. Real change does occur, but it takes a lot of work and sacrifice on the parts of all the adults involved. I?ll tell you what I?ve told many parents in my office: ?It doesn?t end with the diagnosis, it just starts there.?

2 Baltimore attorneys sue Facebook over privacy

(AP) ? Two Baltimore law firms have filed a lawsuit against Facebook, arguing that the site has violated privacy laws.

The Daily Record of Baltimore (http://bit.ly/xicCpO) reports the law offices of William Murphy Jr. and Peter Angelos filed their lawsuit in U.S. District Court in San Jose, Calif. The lawsuit, which also involves a California firm, claims Facebook has used online tracking technology to monitor users even when they are not on Facebook's site.

The two named plaintiffs in the case are Laura Maguire of Charlotte, N.C., and Baltimore resident Christopher Simon.

California-based Facebook said in a statement Wednesday that it believes the case is without merit.

Lawsuits by users of large Internet services over privacy and other grievances are fairly common and typically seek class-action status.

49 killed, 600 hurt in Argentina train crash

A packed train slammed into the barrier at the end of the line at a busy Buenos Aires station, killing 49 people and injuring hundreds of morning commuters in Argentina's worst train accident in decades. Passengers had been packed in tight, sandwiched between bicycles and the few seats, many without so much as a strap to hold onto.

Federal Police Commissioner Nestor Rodriguez said Wednesday's dead included 48 adults and one child.

About 600 people were injured, and emergency workers were slowly extracting dozens of people who were trapped inside the first car, said Alberto Crescenti, the city's emergency medical director. Rescuers carved open the roof and set up a pulley system to ease them out one by one.

Most of the victims were traveling in the first two cars of the eight-car train, which Transport Secretary Juan Pablo Schiavi said was carrying between 1,200 and 1,500 passengers.

The commuter train came in too fast and hit a shock-absorbing barrier at the end of the platform at about 16 mph, smashing the front of the engine and crunching the cars behind it. The second car penetrated nearly 20 feet into the next, Schiavi said.

Commuters inside the train "flew through the air," a passenger wearing a neckbrace who identified himself as Fabio told local television. "There were lots of people thrown to the floor, injured, bloodied."

"The train (car) was embedded inside the other ... the seats were gone, they disappeared, and people were jumping out of the window," he said.

The death toll was Argentina's highest from a train accident since 1970, when 200 were killed.

Hundreds of thousands of people travel into Argentina's capital from the suburbs every day. The dilapidated and overcrowded rail services, run by private companies and heavily subsidized by the state, are plagued by accidents and delays.

Schiavi defended the rail system at a news conference.

"It was an accident like those in many other countries," he said, pointing to a newspaper clipping about a fatal crash in Los Angeles. "In recent years, we've made huge investments" in the system.

As Schiavi spoke, riot police faced off against angry passengers in the closed station, where emergency workers spent hours extracting dozens of people trapped inside the train's first car. Rescuers had to slice open the roof and set up a pulley system to ease them out one by one. Dozens of the injured were lined up on stretchers on the station platform.

One car penetrated nearly 20 feet into the next, Schiavi told reporters at the station.

Most damaged was the first car, where passengers make space for bicycles. Passengers said windows exploded as the tops of train cars separated from their floors.

The trains are usually packed with people standing between the seats, and many were thrown into each other and to the floor by the force of the hard stop.

Helicopters and more than a dozen ambulances took the most seriously injured to nearby hospitals.

"This machine left the shop yesterday and the brakes worked well. From what we know, it braked without problems at previous stations. At this point I don't want to speculate about the causes," Ruben Sobrero, union chief on the Sarmiento line, told Radio La Red.

The train operator has been hospitalized and the union hasn't been able to speak with him yet, Sobrero added.

In September of last year , nine people were killed and more than 200 injured in a crash in Buenos Aires involving two passenger trains and a bus.

In February of last year, four people died and 120 were injured when a long distance train struck a suburban passenger train, according to the AFP news agency.

Male extinction theory challenged

Men may not become extinct after all, according to a new study.

Previous research has suggested the Y sex chromosome, which only men carry, is decaying genetically so fast that it will be extinct in five million years' time.

A gene within the chromosome is the switch which leads to testes development and the secretion of male hormones.

But a new US study in Nature suggests the genetic decay has all but ended.

Professor Jennifer Graves of Australian National University has previously suggested the Y chromosome may become extinct in as little as five million years' time, based on the rate at which genes are disappearing from the chromosome.

Genetics professor Brian Sykes predicted the demise of the Y chromosome, and of men, in as little as 100,000 years in his 2003 book Adam's Curse: A Future without Men.

The predictions were based on comparisons between the human X and Y sex chromosomes. While these chromosomes were once thought to be identical far back in the early history of mammals, the Y chromosome now has about 78 genes, compared with about 800 in the X chromosome.

Jennifer Hughes and colleagues at the Whitehead Institute in Cambridge, Massachusetts, have sought to determine whether rumours of the Y chromosome's demise have been exaggerated.

In a previous Nature paper in 2005, they compared the human Y chromosome with that of the chimpanzee, whose lineage diverged from that of humans about six million years ago.

They have now sequenced the Y chromosome of the rhesus monkey, which is separated from humans by 25 million years of evolution.

The conclusion from these comparative studies is that genetic decay has in recent history been minimal, with the human chromosome having lost no further genes in the last six million years, and only one in the last 25 million years.

"The Y is not going anywhere and gene loss has probably come to a halt," Ms Hughes told BBC News. "We can't rule out the possibility it could happen another time, but the genes which are left on the Y are here to stay.

"They apparently serve some critical function which we don't know much about yet, but the genes are being preserved pretty well by natural selection."

X-Y crossing

Most humans cells contain 23 sets of chromosomes, including one pair of sex chromosomes. In women, this sex pair consist of two X chromosomes, while men have one X and one Y chromosome. It is a gene within the Y chromosome which triggers the development in the embryo of male testes and the secretion of male hormones.

Genetic deterioration of the Y chromosome has occurred because unlike with the two X chromosomes in women, there is very little swapping of genetic material between the Y and X chromosome during reproduction. This means mutations and deletions in the Y chromosome are preserved between (male) generations.

"The X is fine because in females it gets to recombine with the other X but the Y never gets to recombine over almost its entire length, and shutting down that recombination has left the Y vulnerable to all these degenerative forces," said Dr Hughes, "which is why we're left with the Y we have today."

Commenting on the paper, Professor Mark Pagel, an evolutionary biologist at the University of Reading and author of Wired for Culture: Origins of the Human Social Mind, said that while there might be some squabbling in academic circles over the timings of the events, the paper told us there was a future for males in the very long term.

"It's a very nice piece of work, showing that gene loss in the male-specific region of the Y chromosome proceeds rapidly at first - exponentially in fact - but then reaches a point at which purifying selection brings this process to a halt."

TEGUCIGALPA, Honduras (AP) ? U.S. investigators concluded Tuesday that the deadliest prison fire in a century was accidental, and may have been caused by a lit match, cigarette or some other open flame.

President Porfirio Lobo also announced he is pardoning0 a prisoner who helped free hundreds of inmates after the guard with the keys disappeared. In at least one case, a witness said the hero inmate picked up a bench and broke the lock on a cell.

The U.S. Embassy in Honduras said in a statement that a team of investigators from the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives "was able to rule out other possible causes of the fire, such as a lightning strike, electrical causes, or the use of a flammable or combustible liquid."

The death toll from the Feb. 14 fire at the Comayagua prison rose to 360 Tuesday after another victim died in a Tegucigalpa hospital from his burns.

"The fire is believed to have begun in the area of the top two bunk beds in the fourth column along the western side of the prison's module six, which ignited nearby flammable materials," the statement said. "The cause of the fire is believed to have been an open flame (the source of which could include, but is not limited to, a cigarette, a lighter, matches, etc.), although the actual ignition source was not recovered."

The statement called the cause of the fire accidental. There were 105 prisoners crammed into rows of bunks four levels high in the barracks where the fire started. Only four survived.

The statement did not say why the investigative team concluded the fire was set accidentally after Honduran officials first said last week that it was ignited by an angry inmate who had threatened to torch the prison and later that it was caused by inmates who were fighting over a mattress.

The ATF referred all comment to the embassy, which didn't respond immediately to requests for comment on the statement.

Earlier Tuesday, Honduran chief prosecutor Luis Alberto Rubi told Channel 5 television that witnesses had told investigators that a prisoner fell asleep while smoking.

"I think it is irresponsible for the prosecutor to mention isolated data, instead of giving an integrated report," said Andres Pavon, the president of the Human Rights Defense Commission. "It seems he is just throwing stuff out there."

In his weekly meeting with ministers broadcast on Channel 8, Lobo said he would pardon Marco Antonio Bonilla, an inmate who also served as the prison nurse.

"He put himself at incredible risk trying to save lives during the tragedy," Lobo said.

Bonilla could not be reached for comment. Lobo said he would give him a presidential pardon for his murder conviction.

Another prisoner, Rosendo Sanchez Mendez, told The Associated Press last week that Bonilla had only a few more months to serve and was allowed to live apart from the other inmates and walk freely inside the prison.

Some witnesses said the guard responsible for the keys threw them on the ground, while others said Bonilla demanded the keys from the guard and started opening doors. Inmate Jose Enrique Guevara, who suffered burns, said Bonilla picked up a bench and broke the lock on his cell block, No. 6, where the fire started, and saved his life.

Honduran officials' explanation of what happened continued to change last week after the fire raced through five barracks of the Comayagua prison farm, burning and suffocated screaming men who were trapped behind locked doors. Witnesses said the guard with the keys was either scared by flames or refused to open the door.

There were six guards supervising 852 prisoners the night of the fire at the prison about 55 miles (90 kilometers) north of Honduras' capital, Tegucigalpa.

Honduran officials initially said the blaze broke out after an inmate threatened to burn the prison down, including in a cellphone call to Comayagua Gov. Paola Castro. The governor later retracted her story, saying she got only a phone message that there was a fire. She added that she had accidentally erased the message.

Many of the relatives of the inmates killed in the blaze have said they don't believe that the fire started in a single mattress or that it could have spread so quickly in a densely crowded cell, where dozens of inmates would have seen the fire and stomped it out.

"If somebody sets a mattress on fire, smoke starts coming out and the others put it out," said Marco Rivera, 32, a tire shop operator whose nephew, Eduardo Osmar Chaverria Lopez, was one of the inmates presumed dead. "Many people (among the relatives) say gallon jugs of gasoline were found inside, and that it was premeditated."

The ATF statement said it found no evidence of such fuel. It said crowding, poor safety practice and the presence of flammable materials in and around the tightly packed bunk beds caused the rapid spread of the flames. Inmates had clothes, curtains and small electrical devices hung from their bunks. Some also had materials to light makeshift kitchen stoves, according to some of the survivors.

Officials initially put the fire's toll at 355 deaths, but five inmates have since died, raising the total to 360. The latest was Juan Angel Arias, 66, who died Tuesday as a result of his burns, said Dr. Manuel Boquin at Hospital Escuela in Tegucigalpa.

A government report this month said the prison's capacity was 500, and more than half of the 852 inmates crowded inside were awaiting trial. Some had yet to be charged.

HYDE PARK, N.Y. (AP) ? Julio Gerena is in a wheelchair, his long career in the U.S. Navy and Army forever behind him. But the 52-year-old recaptured some of the old military camaraderie while peeling potatoes and chopping cilantro in a crowded kitchen.

Gerena was among the first 16 wounded veterans who served during the Iraq and Afghanistan wars to take part in a healthy cooking "boot camp" sponsored by the advocacy group Wounded Warrior Project. Former service members once consumed with patrols and sentry posts learned how to poach and saute at the Culinary Institute of America, the renowned cooking school on the Hudson River.

The veterans learned some kitchen tips, but seemed to enjoy even more the chance to spend four intense days with people who have faced similar hurdles.

"There are some things you can't really get into words, but the Wounded Warrior program is to me what being in uniform was before: the camaraderie, the trust," Gerena said after a long morning in the kitchen. "I met some of these people just a few days ago, but I share what they went through."

The Jacksonville, Fla.-based organization runs a range of programs for wounded veterans at locations ranging from college campuses to ski slopes. The group brought its first batch of veterans into the kitchen last week in partnership with the culinary institute. Most of the students served in the Army, but the Navy and the Marines were also represented. Their service-related wounds ranged from spinal cord injuries to post-traumatic stress disorder.

Over four days, they were lectured on the finer points of knife work or braising before heading to a classroom kitchen to turn the lesson into something edible for lunch or dinner.

On a recent morning, the veterans scrambled to pan-sear salmon and saute chicken breasts under the guidance of Chef John DeShetler. As they clattered pans and joked about a return to kitchen patrol duty, DeShetler shouted out tips on carrot dicing and meat slicing.

"Now this is a flank steak! There's only two per animal, that's why they're so damn expensive...! They used to give this away!" DeShetler bellowed.

As DeShetler walked the kitchen, 24-year-old Steve Bohn carefully saut?ed mushrooms for a ragout in a pan.

The Peabody, Mass., resident had cooked for a Whole Foods Market before the death of close friend in Iraq inspired him to join the Army in 2007. Bohn was severely injured the next year in Afghanistan when a dump truck packed with explosives collapsed the building he was in. He suffered severe spinal injuries and required reconstructive bladder surgery.

Bohn no longer needs a leg brace but he still had a hitch to his step as he moved through the kitchen. He knows that he cannot resume his old kitchen career because he can't stand for long or lift heavy boxes. But he liked the feeling of pushing his limits and being behind a burner again.

"I lost the passion, kind of, after going to war and going through all that. I just want to get the passion back," he said.

The veterans came to the school north of New York City from around the Northeast and were assigned to one of four teams. Each team had to work together to execute a different recipe representing a balanced meal. The parallels to the military practice of assigning set teams to specified tasks was intentional, even if the mission here was to make a decent lunch.

While they want to teach veterans how to cook healthier ? a particular concern for those with limited mobility ? Wounded Warrior spokesman Pete Cataldo said they also want to give participants a chance to bond with each other. Like all Wounded Warrior programs, the culinary course is ultimately designed to "honor and empower" the veterans.

"They kind of draw veterans together instead of letting us kind of sink into the cracks. They're there," Gerena said. "If they don't hear from you, I always get a call, 'Hey, what's going on? How are you doing?'"

Gerena joined the Navy as a teen in 1976 and later did a stint in the Army Reserves. He was called back into active duty in 2004. He doesn't like to talk about his shoulder and back injuries. But he was hurt stateside and required surgeries before a decline that led to the wheelchair. He had been in law enforcement around New Orleans in his civilian life, but could no longer do that after his injury.

Gerena moved back to his family in New York City, where he said he can feel a sense of isolation rolling down a busy sidewalk. "Like a ghost," he said.

"Maybe because it's New York City ... I'm not that small a person in a wheelchair, but it just seems like I'm invisible to them, or sometimes maybe even a nuisance. Rush hour, wall of traffic, you get a wall of people walking at you, he's trying to get home, too. The Wounded Warrior Project stops that."

Wounded Warrior and the culinary institute will run two more boot camps at Hyde Park in March. There are hopes to expand the program to the culinary institute's campuses in northern California and San Antonio.

This first group finished up Friday, but not before getting to eat their own creations of sauteed pork cutlets and cilantro-lime brown rice pilaf. And they received a new uniform: white chef's tunic with a Wounded Warriors patch.

"I do want to take better control of my diet," Gerena said. "My mother's old school: rice and beans and meat. That's what I was growing up with. ... Probably will go home and be more confident to take over."

(AP) ? The superintendent of the West Virginia coal mine where an explosion killed 29 men was charged Wednesday with conspiracy to defraud the federal government, becoming the highest-ranking employee to face criminal prosecution in an investigation that appeared to be moving steadily up the corporate ladder.

Former Upper Big Branch mine boss Gary May, 43, of Bloomingrose, W.Va., is named in a federal information, a document that signals a defendant is cooperating with prosecutors. He is the second employee of Massey Energy, the company that owned the mine at the time of the 2010 tragedy, to face prosecution.

Reached at his home Wednesday morning, May declined comment. A conviction on the federal fraud charge could result in fines and up to five years in prison.

U.S. Attorney Booth Goodwin said his investigation of the worst U.S. mine disaster in four decades is "absolutely not" finished, signaling that officials are now exploring possible criminal charges against even higher-level executives of the company. Goodwin did not immediately comment further.

Although other mine disasters have led to criminal charges, they've typically targeted low-ranking employees and have largely been misdemeanor offenses.

"Usually, they get the mine foreman because that's the person that signs the books," said Gary Quarles, whose son Gary Wayne died in the explosion. Superintendents are usually shielded, he added.

But Quarles said the charge announced Wednesday suggest prosecutors are looking at May's bosses, too.

"It's about time," he said. "It's a good start."

Last week, Goodwin urged a federal judge in Beckley to make an example of the only other person charged so far, former security chief Hughie Elbert Stover. Goodwin is demanding the maximum possible sentence of 25 years in prison for actions he says contributed to the April 2010 disaster near Montcoal.

Stover is to be sentenced Feb. 29 for lying to federal investigators and attempting to destroy documents.

May began working at Upper Big Branch in February 2008 as a mine foreman and was promoted in October 2009 to superintendent. He held that post, overseeing three room-and-pillar mining sections and a longwall operation, until the day the mine exploded on April 5, 2010.

The information filed in U.S. District Court in Beckley accuses May of conspiring with others to conceal many dangers in the mine through an elaborate scheme that included code words to alert miners underground when inspectors were on the property, the deliberate alteration of approved ventilation plans and the deliberate disabling of a methane gas monitor on the continuous mining machine.

May allegedly ordered the wiring to be altered in February 2010 so the automatic shut-off mechanism was disabled, allowing the machine to function for several hours without a methane monitor.

Other employees of the mine have told investigators there was never enough fresh air to sweep out the highly explosive methane and coal dust that regularly accumulated ? the fuel that three separate investigations have concluded powered the chain-reaction blast.

The information also says that when May knew the Mine Safety and Health Administration was about to sample the level of breathable coal dust in a section of the mine, he surreptitiously redirected additional air to that area to obscure the typical conditions.

May is also accused of both falsifying safety inspection books and ordering someone not named in the information to leave out reports of deep water that would have made a section of the mine unsafe.

Clay Mullins worked at Upper Big Branch and lost his brother Rex in the blast, but didn't cross paths with May.

"It's what we wanted. All the families, it's what they want," he said of the charge against the superintendent. "But I want to see some other names. ... There were a lot of people involved in this, and I just want to see them be punished for the crimes.

"If they're innocent, then I want them to be found innocent," Mullins said. "But if they're guilty, I want them to face the maximum penalty of law."

The information says Massey subsidiary Performance Coal Co. and its managers routinely violated a host of federal mine-safety laws for fear that violations would cut into production time.

Had MSHA detected the concealed conditions, it would have resulted in temporary shutdowns and fines. That also could have moved Massey closer to being designated a pattern violator, which would have subjected it to even more scrutiny.

Reports about the explosion have already been released by MSHA, the United Mine Workers of America and an independent panel appointed by the former governor. The fourth and final report, by the state Office of Miners' Health Safety and Training, is being released Thursday.

The first three concluded that Virginia-based Massey Energy ? which has since been bought by Alpha Natural Resources ? allowed methane and coal dust to accumulate, and failed to properly maintain and repair the cutting equipment that eventually created the spark that fuel needed to explode.

Clogged and broken water sprayers then allowed what could have been a minor flare-up to become an epic blast that traveled seven miles of underground corridors, doubling back on itself and killing men instantly.

All three reports said the explosion could have been prevented or contained if the mine had been sufficiently dusted with pulverized limestone to render the coal dust inert. In the year before the Upper Big Branch blast, 70 ignitions occurred at U.S. coal mines, and none resulted in fatalities.

The UMWA report accused Massey of "industrial homicide" for the way it ran Upper Big Branch and listed 18 employees, including former Chief Executive Officer Don Blankenship, who invoked their right to avoid self-incrimination and refused to cooperate with investigators.

May is one of the 18 that the UMWA says should be compelled to publicly plead their Fifth Amendment rights or be held in contempt of court.
